Terms of Service

Effective date: 27 August 2026
Last updated: 27 August 2026

These Terms of Service ("Terms") govern your use of the website at https://equalpixels.io and of the customer messaging services that Equal Pixels ("Equal Pixels", "we", "us", "our") operates on the WhatsApp Business Platform. Please read them before using our website or messaging us on WhatsApp.

By using our website, by messaging our WhatsApp Business account, or by opting in to receive WhatsApp messages from us, you agree to these Terms. If you do not agree, please do not use our website or our messaging services.

1. Who we are

Service provider: Equal Pixels
Website: https://equalpixels.io
Contact: [email protected]

2. What we provide

Equal Pixels provides:

  • This website — information about our work, services and contact channels.
  • Customer support over WhatsApp — you can message our WhatsApp Business account with a question or request, and a member of our team or an automated assistant will respond.
  • Notifications and alerts over WhatsApp — where you have opted in, we send transactional messages such as order and delivery updates, appointment reminders, service notices and one-time passcodes.
  • Automated and AI-assisted chat assistants — some conversations are handled in whole or in part by automated flows rather than by a person.

We may add, change, suspend or withdraw any part of these services at any time. Where a change materially affects you, we will give reasonable notice.

3. Eligibility

You must be at least 18 years old to use our services. If you are using our services on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" then refers to that organisation.

You must also comply with WhatsApp's own terms, including the WhatsApp Terms of Service, when using WhatsApp to communicate with us.

4. Messaging us on WhatsApp

Opt-in. We only send WhatsApp messages to people who have opted in. You opt in through a clear, affirmative action — ticking a checkbox, submitting a form, using a WhatsApp link or QR code to start a conversation, or telling us in chat that you want to receive messages.

Opt-out. You can stop receiving messages from us at any time. Reply STOP to any of our WhatsApp messages, tell our agent or assistant that you want to stop, or email [email protected]. You can also block or report our number inside WhatsApp. We action opt-outs promptly.

Message and data charges. WhatsApp messages are delivered over your internet connection. Your mobile network or internet provider may charge you for data. Those charges are between you and your provider.

Not for emergencies. Our WhatsApp channel is monitored during business hours and is not a guaranteed or real-time channel. Do not use it to report an emergency, a safety risk, or anything requiring urgent attention. Contact the appropriate emergency service instead.

Do not send sensitive information. Please do not send us passwords, full payment card numbers, bank credentials, national identity numbers or health information over WhatsApp. If you do, we remove it from our records when we become aware of it, but we cannot undo the fact that it was transmitted.

5. Automated and AI-assisted assistants

Some of our WhatsApp conversations are handled by automated flows and AI-assisted assistants. Where that is the case:

  • We tell you that you are speaking to an automated assistant.
  • You can ask to be transferred to a human at any time, and we will do so during business hours.
  • Automated responses may be incomplete, out of date or wrong. They are provided for convenience and general information only.
  • Nothing an automated assistant says constitutes legal, financial, medical or other professional advice, and it does not create a binding commitment on our part. Where an automated reply conflicts with something confirmed in writing by a member of our team, the written confirmation prevails.
  • Automated processing is used to route, summarise and answer enquiries. It is not used to make decisions that have a legal or similarly significant effect on you without human review.

6. Acceptable use

When using our website or messaging us, you agree not to:

  • Break any applicable law, or infringe anyone's rights.
  • Send abusive, threatening, harassing, hateful, defamatory, obscene or sexually explicit content.
  • Impersonate another person or organisation, or misrepresent your identity or affiliation.
  • Send spam, bulk unsolicited messages, chain messages, or content promoting a competing or unrelated commercial offer.
  • Upload or transmit malware, or attempt to gain unauthorised access to our systems, accounts or data.
  • Probe, scan, overload, disrupt or interfere with our website, our WhatsApp number or our infrastructure, including by automated scraping, crawling or bulk messaging.
  • Use our services to collect, harvest or process other people's personal data without a lawful basis.
  • Reverse engineer, copy or resell any part of our services.

We may withhold a response, restrict access, or block a number or IP address that we reasonably believe is in breach of this section.

7. Information you send us

You keep ownership of the content you send us. By sending it, you grant us a non-exclusive, royalty-free licence to use, store, copy and process it as needed to respond to you, provide our services, keep records of the conversation and comply with our legal obligations.

You confirm that you have the right to send us the content, and that doing so does not breach anyone's rights or any law or duty of confidence.

How we handle personal data is set out in our Privacy Policy. You can ask us to delete your data at any time — see our Data Deletion Policy.

8. Our intellectual property

The website, its content, design, code, text, graphics, logos and the Equal Pixels name and brand are owned by Equal Pixels or our licensors and are protected by intellectual property law. Nothing in these Terms transfers any of those rights to you.

You may view and print pages from the website for your own information and internal business use. You may not otherwise copy, republish, adapt, distribute or commercially exploit our content without our written permission. Any feedback or suggestions you send us may be used freely and without obligation to you.

9. Third-party services and links

Our messaging service runs on the WhatsApp Business Platform, operated by Meta Platforms, Inc. and WhatsApp LLC / WhatsApp Ireland Limited. Your use of WhatsApp is governed by WhatsApp's own terms and policies, and we do not control the availability, delivery or performance of the WhatsApp platform.

Our website may link to third-party sites and services. We provide those links for convenience and do not control, endorse or take responsibility for third-party content, terms or privacy practices.

10. Availability and disclaimer

We aim to keep our website and messaging service available and accurate, but we provide them on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, that:

  • the services will be uninterrupted, timely, secure or error-free;
  • any message will be delivered, delivered on time, or received by the intended recipient;
  • the content or any automated response will be accurate, complete or current; or
  • the services are fit for any particular purpose.

Nothing on our website or in a WhatsApp conversation is an offer capable of acceptance, or professional advice you should rely on without confirming it with us in writing.

11. Limitation of liability

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Subject to that, and to the fullest extent permitted by law, Equal Pixels is not liable for:

  • indirect, incidental, special, punitive or consequential loss;
  • loss of profit, revenue, business, goodwill, opportunity or anticipated savings;
  • loss or corruption of data;
  • failure or delay of the WhatsApp platform, your network provider, or any other third-party service; or
  • reliance on an automated or AI-generated response that was not confirmed in writing by our team.

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with your use of our website and messaging services is limited to the greater of the amount you have paid us in the twelve months before the claim arose, or PKR 25,000.

12. Indemnity

You agree to indemnify us against reasonable claims, losses, damages and costs arising from your breach of these Terms, your misuse of our services, or content you send us that infringes a third party's rights or breaks the law.

13. Suspension and termination

You can stop using our services at any time, and opt out of WhatsApp messages using the methods in section 4.

We may restrict, suspend or end your access to our website or messaging services, with or without notice, if you breach these Terms, if we are required to by law or by Meta's or WhatsApp's platform policies, or to protect our systems, our team or other users. Sections that by their nature should survive — including sections 7, 8, 11, 12 and 14 — continue to apply after termination.

14. Governing law and disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan. The courts of Pakistan have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that we may seek injunctive relief in any competent jurisdiction to protect our intellectual property or systems.

If you are a consumer resident elsewhere, this does not affect any mandatory rights or protections you have under the law of your country of residence.

Before starting formal proceedings, please contact us at [email protected] so we can try to resolve the matter directly.

15. Changes to these Terms

We may update these Terms to reflect changes in our services, our providers or the law. We will change the "Last updated" date above and, where the change is significant, give notice by WhatsApp, by email, or through a prominent notice on our website. Continuing to use our services after a change takes effect means you accept the updated Terms. The current version is always available at https://equalpixels.io/terms-of-service/.

16. General

If any provision of these Terms is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours to a successor in connection with a merger, restructuring or sale of our business. These Terms, together with our Privacy Policy and Data Deletion Policy, are the entire agreement between us regarding your use of our website and messaging services.
